Terms and Conditions

 I. PRELIMINARY PROVISIONS

1. The Regulations set forth the terms and conditions for the provision of services by the Service Provider, as well as the terms and conditions for the use of the mastersworkshops.com website by the User.

2. Whenever these Regulations refer to:
- Service Provider, it should be understood as  Space Films Sp. z.o.o -  Space Films limited liability company with its registered office in Warsaw (Żegiestowska 18C, 02-924 Warsaw, Poland) entered in the National Court Register kept by the District Court for the City of Warsaw in Warsaw, XIII Economic Department of the National Court Register under KRS number: 0000869613; NIP: 5213913394; REGON: 387617634, share capital of 5000 PLN, paid in full.
- User, it should be understood as any person visiting the pl website.
- Consumer, it should be understood as a natural person using the services for purposes not related to the provision of professional services or business.
- Account, it should be understood as a part of the site warsztatymistrz.pl intended for registered Users.
- Service, it should be understood as services provided by the Service Provider through the warsztatymistrza.pl website.
- Workshop, it should be understood as audiovisual recordings possible to be played on the warsztatmistrza.pl website.
- Regulations, it should be understood to mean these Regulations.
- Privacy Policy, this should be understood as the document available in the Privacy Policy tab.
- Gift Card - Voucher: An electronic document with a code that a user can generate and give to another person in order to allow them to receive a course on our platform for free.
3. To the extent that these Regulations regulate the provision of services by electronic means, they shall be the regulations referred to in Article 8 of the Law on Provision of Electronic Services.

4. Each User shall be obliged to comply with its provisions of the Regulations.

5. The Regulations are made available to Users free of charge in the Terms of use tab.

II. SERVICES

1. The Service Provider shall provide Users with a website within which, in particular, it is possible to gain temporary access to the Workshops transmitted via streaming over the Internet.
2. In connection with the provision of the website, the Service Provider shall provide, among others, the following Services:
- the ability to browse the website as an unregistered User;
- gaining free access to sample episodes of the Workshops;
- registering a User Account;
- gaining access to purchased episodes of the Workshops;
- purchasing a gift card;
- enabling the rating and publication of content regarding the Workshops for registered Users, as well as -.
viewing content published by other Users;
- making the catalog of purchased Workshops available;
- making payment information available.
3. The Services of the Service Provider provided electronically, except for the Service of gaining access to the Workshops and purchasing a gift card, are free of charge.

III. GENERAL CONDITIONS

1. The use of the Services is possible through any type of Internet connection, on screens with a minimum screen resolution of 1280 x 1024 pixels, using any type of computer, tablet or telophone using the following Internet browsers. Microsoft Edge version 17 or later with ActiveX, JavaScript and Cookies enabled, or Mozilla Firefox version 68 or later with Java applets, JavaScript and Cookies enabled, or Opera version 58 or later with Java applets, JavaScript and Cookies enabled, or Google Chrome version 75 or later with Java applets, JavaScript and Cookies enabled, Before using the Services, it is recommended that the User verify that the computer equipment he has meets the technical requirements specified above.
2. the User wishing to use all functionalities of mastersworkshops.com must register an Account.
3. the User registering an Account on the site is required to provide his/her e-mail address, provide a password and accept the Regulations and Privacy Policy. Login and password may be changed by the User.
4. the User is obliged to provide complete and truthful information, including personal data, required during registration or for payment purposes, and to keep them updated.
5. Only one Account may be assigned to one e-mail address.
6. After registration, the User will be able to purchase access to the Workshops.
7. in some cases it is possible to gain access to the Workshops without registering an Account. Users interested in this possibility must contact the Service Provider at: support@mastersworkshops.com.
8. Purchase of access to the Workshop may be made only by persons who are at least 18 years old.
9. gaining access to certain Workshops requires the age of 18.

IV. ACCESS TO THE WORKSHOP

1. Access to the Workshops is granted from the moment of payment by the User for a period of 12 months, and after this period the Workshops continue to be available to the User for as long as they are available on the Platform.
2. The conclusion of the agreement for the User to gain access to the Workshops shall be reached by the User making a payment in the amount set by the Service Provider.
3. Prior to gaining access to the Workshops, the User shall read the Terms and Conditions and Privacy Policy and make a statement that he/she is familiar with the contents of these documents by marking the chceckbox.
4. Any notifications regarding access to the Workshops are displayed in the registered User's account or directed to the User's email address provided at registration.
5. The User may use up to 3 different terminal devices after purchasing access to the Workshops.
6.The quality of the image is dependent on the requirements of the external provider and may vary from device to device. It may also depend on a number of other factors, such as location, available bandwidth and/or internet connection speed. Access to HD resolution depends on the parameters of your Internet connection and the capabilities of your device.
7 You may not allow other third parties to access the Workshop. You are responsible for the security of your Account and keeping your access data confidential.
8. the User acquires access to the Workshops solely for his/her own use. Any use, including dissemination, copying, modification, and making the training available to third parties, individually or publicly, whether paid or unpaid, entitles the Service Provider to revoke the User's access to the Workshops, as well as to pursue claims for damages on general principles.
9. The User may, after 14 days from the conclusion of the Agreement, cancel access to the Workshops without giving any reason by deleting his/her Account or by submitting an appropriate statement to the Service Provider. In such a situation, there is no refund for the paid Workshops.
10. The Workshops constitute a work within the meaning of the Copyright Act and are protected by copyright and related rights vested in the Service Provider.
11. The Service Provider grants the User a non-exclusive, non-transferable, non-transferable, granted for the period of time for which access is granted, limited to the territory of the Republic of Poland, taking into account the extraterritorial nature of the Internet, license to use the Workshops.
12 The license entitles the User only to reproduce the Workshops on the device. The license will terminate upon termination of the Services by the Service Provider. The User is not entitled to any other rights, including intellectual property rights, beyond those expressly stated in the Terms of Use. The User is not allowed to copy, modify and distribute and reproduce the Workshop in whole or in part.
13.The User acknowledges that failure to comply with the above obligation may result in violation of the Service Provider's copyrights in the Workshop and the possibility of the User being held legally liable for this.

V. RIGHT TO WITHDRAW FROM THE AGREEMENT (“Satisfaction Guarantee” by the Service Provider).

1.The user has the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the conclusion of the contract. In order to exercise the right of withdrawal, the user must inform S Space Films Sp. z.o.o , Żegiestowska 18C, 02-924 Warsaw, Poland, support@mastersworshops.com of their decision to withdraw from this contract by an unequivocal statement (for example, by e-mail). In order to observe the deadline for withdrawal, it is sufficient for you to send information on the exercise of your right of withdrawal before the expiry of the deadline for withdrawal.
2.Effects of withdrawal from the contract
In the event of withdrawal from this contract, we will return to you all payments received from you, immediately and in any case no later than 30 days from the day we are informed of your decision to exercise your right of withdrawal from this contract. We will return the payment using the same means of payment that you used in the original transaction, in any case you will not incur any fees in connection with this return.

VI. GIFT CARD- VOUCHER

General Conditions
a. Gift Card - Voucher is available only to registered users of our platform.
b. The user cannot use the Gift Card - Voucher by himself. He can gift it to another person.
c. Each User has the right to generate a Gift Card - Voucher only once.
d. The value of the voucher is determined in advance by the service provider.
Generating a Voucher
a. A User can generate a Gift Card - Voucher by providing the relevant information on our platform.
b. The user must provide information about the Recipient, such as his/her name, to generate a Gift Card - Voucher.
Liability
a. The user is responsible for correctly providing the Recipient's information when generating the Gift Card - Voucher.
b. We are not responsible for the loss, theft or misuse of the Gift Card - Voucher after it has been generated.

VII. PAYMENTS

1. Prices for the Services are expressed in US dollars and represent the total price of the Service.
2. In some countries, the price will be higher by the value added tax automatically added before payment.
3. If you wish to obtain an invoice for the purchase of a Service, you must inform the Service Provider by marking and entering your Business Tax ID.
4. the online payment service provider for card payments is Stripe.com.
Available forms of payment:
Visa, Visa Electron, Mastercard, MasterCard Electronic, blik, quick payments.
5. Payment for the Service will be collected by the payment service provider, i.e. a third-party online payment processing institution to process the payment instruction submitted by the User. The Service Provider does not directly handle payment transactions and is not a payment service provider or payment institution within the meaning of the Payment Services Act of August 19, 2011.
6. Considering the fact that the Service Provider is not a payment institution or payment service provider within the meaning of the Payment Services Act, any complaints regarding payments made with a payment card should be submitted directly to individual payment service providers or to the issuer of the User's payment instrument. Complaints regarding payments submitted to the Service Provider will be forwarded to the relevant payment service provider, of which the Service Provider will notify the User by email. The Service Provider stipulates that it is not responsible for any consequences of the delay in forwarding the complaint to the relevant payment service provider.

VIII. PUBLISHING CONTENT

1. The User may publish i.e. comments and evaluations, concerning only the Workshops he/she has used. The Service Provider may moderate content that violates applicable laws, rights of third parties or good morals.
2. The published content must not violate the law, personal rights or rules of social coexistence. The user is solely responsible for the published content.
3. The Service Provider is not responsible for the content published by the User. The Service Provider does not monitor and moderate the content published in the Application by the User, with the proviso that the Service Provider is entitled to remove the content referred to in the paragraph above.
4. Upon posting the content, the User grants the Service Provider a non-exclusive, royalty-free license to use the content posted on the site in accordance with the Terms and Conditions in the following fields of exploitation, known at the time of granting the license:
- in the field of recording and multiplication of the work - production of copies of the work by a specified technique, including digital, magnetic recording, printing and reprography techniques;
- within the scope of circulation of the original or copies on which the work was fixed - introduction into circulation of the original or copies of the work;
- within the scope of dissemination of the work in a manner other than specified above - public performance, exhibition, display, reproduction, as well as broadcasting and re-broadcasting, as well as making the work available to the public in a manner allowing everyone to have access to it at a place and time individually chosen by them, including making the work available on the Internet.
5. The scope of the above license includes the right of the Service Provider to use the anonymized
content to ensure the operation, promotion and advertising of its Services, even after the User has deleted the Account.

IX. RESPONSIBILITY

1. The shaping, development and maintenance of the site are the exclusive rights of the Service Provider.
The Service Provider is entitled, in particular, to modify and delete the site, as well as to transfer the rights to the site to a third party, together with the user base, who agree to this. A user who does not consent to such transfer is obliged to delete the Account or withdraw consent to the newsletter.
2. In the event of violation of the provisions of the Regulations, the law, or if the User takes actions detrimental to the good name of the Service Provider, other Users or third parties, as well as if the Service Provider receives an official notice or obtains reliable information about the unlawful nature of the published data or related activities, the Service Provider is entitled to remove the content published by the User and temporarily block or delete the Account.
3. The Service Provider shall not be liable for:
- interruptions in the functioning of the site resulting from causes lying on the side of the User and beyond the control of the Service Provider, in particular constituting force majeure;
- technical problems or difficulties related to the operation of the User's terminal equipment that hinder or prevent the use of the site;
- damages caused by any User as a result of his/her violation of the rights of third parties;
damages incurred by the User in connection with the blocking or removal from the Account in connection with violation by that User of the provisions of the Regulations or generally applicable laws.
4. the Service Provider shall be entitled to partially or completely shut down the site for the purpose of repairing or upgrading the site, with the Service Provider agreeing to minimize the time during which the partial or complete shutdown of the site's operation will occur.

X. COMPLAINTS

1. Any complaints about irregularities in the operation of the site may be reported by Users using the services for purposes unrelated to their professional or business activity in any way, including by appropriate notification sent by e-mail to the email address: support@mastersworkshops.com or in writing to the Service Provider's registered address.
2. The complaint should include at least: the name, surname and contact details of the person making the complaint and a description of the reason for the complaint.
3. The Service Provider will consider the complaint within 30 (thirty) days from the date of its receipt.
4. Immediately after considering the complaint, but no later than within the period indicated above, the Service Provider will respond to the User regarding the complaint. The response will be sent to the e-mail or delivery address provided by the User in the complaint. In the event that the complaint does not contain data allowing the User to send a response to the complaint, it will remain for collection by the User at the Service Provider's premises at its registered address.
5. The Service Provider reserves the right to request additional information from the User in a situation where it is required to recognize the complaint.
6. In the case of exhaustion of the complaint route, the User has the opportunity to use out-of-court means of processing 7.  The didactic content and substantive quality of the Workshops are not subject to complaint.

XI. Use of Communications Facilities

1. When using any System on the Website you should do so in accordance with the following rules. Failure to comply with these rules may result in your Account being suspended or closed:
2. You must not use obscene or vulgar language;
3. You must not submit Content that is unlawful or otherwise objectionable. This includes, but is not limited to, Content that is abusive, threatening, harassing, defamatory, ageist, sexist or racist;
4. You must not submit Content that is intended to promote or incite violence;
5. It is advised that submissions are made using the English language as We may be unable to respond to enquiries submitted in any other languages;
6. The means by which you identify yourself must not violate these Terms and Conditions or any applicable laws;
7. You must not impersonate other people, particularly employees and representatives of or Our affiliates; and
8.You must not use Our System for unauthorised mass-communication such as "spam" or "junk mail".
9. You acknowledge that reserves the right to monitor any and all communications made to Us or using Our System.
10. You acknowledge that may retain copies of any and all communications made to Us or using Our System.
11. You acknowledge that any information you send to Us through Our System may be modified by Us in any way and you hereby waive your moral right to be identified as the author of such information. Any restrictions you may wish to place upon Our use of such information must be communicated to Us in advance and We reserve the right to reject such terms and associated information.

XII. Disclaimers
1.We make no warranty or representation that the Website will meet your requirements, that it will be of satisfactory quality, that it will be fit for a particular purpose, that it will not infringe the rights of third parties, that it will be compatible with all systems, that it will be secure and that all information provided will be accurate. We make no guarantee of any specific results from the use of our Service or Services.
2. No part of this Website is intended to constitute advice and the Content of this Website should not be relied upon when making any decisions or taking any action of any kind.
3.No part of this Website is intended to constitute a contractual offer capable of acceptance.
4. Whilst We use reasonable endeavours to ensure that the Website is secure and free of errors, viruses and other malware, you are strongly advised to take responsibility for your own internet security, that of your personal details and your computers.
4. The Website is provided “as is” and on an “as available” basis. uses industry best practices to provide a high uptime, including a fault-tolerant architecture hosted in cloud servers. We give no warranty that the Website or Facilities will be free of defects and / or faults and we do not provide any kind of refund for outages. We provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality.

We accept no liability for any disruption or non-availability of the Website resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.

XIII. FINAL PROVISIONS

1. The Regulations are effective as of 13.09.2024
2. Those who are interested may contact the Service Provider for information about the terms of cooperation.
3. The Service Provider is entitled to amend the provisions of the Regulations at any time.
4. In the event of amendments to the Terms and Conditions, the Service Provider shall inform the User by making the consolidated text of the amended Terms and Conditions available on the website at least 14 days in advance. In the case of registered Users, such change will be sent to the e-mail address provided at registration.
5.Matters not covered by these Regulations shall be governed by the provisions of generally applicable law in Poland, in particular the provisions of the Civil Code, the Act on Electronic Provision of Services and the Act on Consumer Rights.

XIV. Law and Jurisdiction

These Terms and Conditions and the relationship between you and Space Films Sp. z.o.o shall be governed by and construed in accordance with the Law of Poland and Space Films Sp. z.o.o and you agree to submit to the exclusive jurisdiction of POLAND.
